Section 3
Can declare a protected monument area:

(1) If the government of Nepal wants to declare a place or area with an ancient monument as a protected monument area, it shall open four forts, and one copy of the notice shall be issued at the place where the monument is located and at the public place near that place.

(2) A person who is not satisfied with the notification under sub-section (1) can file a complaint before the Government of Nepal within thirty-five days from the date of the notification.

(3) Sub-section (2) The Government of Nepal can give a final decision on the complaint filed as per the following.

(4) If there is a complaint against the notification under sub-section (1), after the final decision has been made as per sub-section (3) and if there is no complaint, after the deadline for filing the complaint has expired, the Government of Nepal shall publish the notice in the Nepal Gazette.

(5) Within the protected monument area, someone installs a telephone or electric line, digs land for water supply or sewage, Construction or repair of roads, shooting of movies, festival-fair, dance-song or parking of vehicles or putting up poster pictures should be approved from the Department of Archeology as prescribed. However, it is not necessary to take the approval of the Department of Archeology to conduct traditional dances, songs, festivals and fairs. When repairing, reducing or reconstructing a building, it should be constructed, repaired, reduced or reconstructed in accordance with the standards set by the Department of Archeology in such a way that it matches the style of the house or building in that area.
(7) A map submitted by a person who wants to construct, repair, add or rebuild a house or building in a protected monument area within the municipal area shall be approved by the Department of Archeology before the municipality passes it in accordance with the prevailing law. After studying the map received from the municipality for approval, the department of archeology can give approval, not give or give approval with amendments.p>

(8) In the case of construction, repair, addition or reconstruction of a house or building in the protected monument area, if it is not done according to the approved map, the Department of Archeology may order to stop the construction, repair, addition or reconstruction of such house or building.

(9) The house or building constructed, repaired, reduced or reconstructed in violation of the order given by the Department of Archeology in accordance with sub-section (8) shall be given a period of thirty-five days by the Urban Development Planning Implementation Committee where the town plan is approved and by the Chief District Officer of the respective district where the town plan is not approved. He can give an order to demolish it. A person who is not satisfied with such an order can file a complaint with the Government of Nepal within thirty five days. The decision of the Government of Nepal regarding such complaints will be final.
(10) If there is no complaint against the order to demolish a house or building according to sub-section (9), within seven days from the date of expiry of the deadline for making such a complaint, and if a decision is taken by the Government of Nepal to demolish such a house or building after any complaint, within twenty one days from the date of such decision. The person will have to demolish the house or building. If the house or building is not demolished within that period, the agency or officer who gave such an order will demolish the said house or building and all the expenses incurred during such demolition will be recovered from the concerned person.
